My Favourite Jersey.com ("MYFJ.com" or "the Site") is a social and community website that connects people who live in or love Jersey, where views and experiences relating to Jersey can be shared and enjoyed.
Definitions:
Community Member: means any person (including a corporate entity) who accesses, uses, engages or contributes to the Site or Web Service or who contracts with the Company;
the Company: means My Favourite Jersey Limited, a Jersey registered company (number 95680) whose registered office is situate at Thomas Edge House, Tunnell Street, St Helier, Jersey JE2 4LU, which expression shall include its successors, administrators, employees, agents and its corporate or other affiliates;
Content: means any profile (including a person?s name, photograph or image) personal information, information, text, view, opinion, fact, photograph, image, mark, trade mark, note, listing, advertisement and any other content that is used, displayed, posted or applied to a profile or the Site or the Web Service;
the Site: means My Favourite Jersey.com otherwise MYFJ.com and [other site names];
Terms and Conditions: means these term and conditions and the Privacy Policy below otherwise the "Agreement" and any substitution of or amendment to the same;
Web Service: means the Site, service and network operated by the Company;
Headings are for identification purposes only and unless the context otherwise requires words herein importing the singular shall include the plural and vice versa and the masculine gender shall include the feminine and the neuter and vice versa in each case and words importing persons shall include bodies or persons with a corporate or incorporate and references to any clause or schedule shall refer to a clause hereof or a schedule hereto
By accessing or using the Site and Web Service (or any of them) operated by the Company you ("the User" which expression shall include a Community Member) represent and signify that you have read, understood and agreed to be bound by our Terms and Conditions whether or not you are a Community Member. The Company reserves the right at any time and without notice at our sole, absolute and unfettered discretion to alter, change, amend, modify, extend, clarify, add to or delete any part or portion of these Terms and Conditions and without obligation to notify you of any change, provided that we post such change on the Site together with the date of such change. Your use or continued use of the Site or Web Service after such change will constitute agreement or acceptance to the changes and the Terms and Conditions as amended, which you are deemed to have read and understood. It is your duty and responsibility to regularly check the Site and the Terms and Conditions to determine if there are any changes. If you do not agree to accept such responsibility or do not agree and accept to be bound or abide by these or any future Terms and Conditions DO NOT use, access or continue to use or access the Site or the Web Service.
Posting
The Content posted on these pages by Users, Community Members, or by the Company relative to a Community Member may be retrieved solely by such Community Member for your own personal use and may be downloaded to your own hard disk or sent to a printer solely for that purpose. You may not otherwise copy, modify or distribute the contents of these pages without the express permission of the Company.
Portions of these pages provide Users an opportunity to promote or exchange ideas and information. The ideas and information posted do not necessarily reflect the views of the Company. While using these pages, you agree not to post, transmit or otherwise distribute any material that may be unlawful, obscene, defamatory, threatening, infringing on any copyright or other rights of others, or damaging to software or hardware. By auditioning with the Company or by posting Content to the Site, you give the Company authority at our discretion to make copies thereof as we deem appropriate in order to facilitate the posting, storage and exploitation of such Content on the Site or through the Web Service. The User or Community Member in providing or posting Content to the Site grants (in doing so you represent, undertake and warrant that you have right to such Content), to the Company an irrevocable, perpetual, non-exclusive, transferable, fully paid licence (with the right to sub-licence) to use, copy, post, display, reproduce, review, edit or to take excerpt therefrom and display, distribute and exhibit such Content for any purpose whether commercial or non commercial, for advertising purposes or otherwise, on or in connection with the Site the Web Service or the promotion thereof. You may request removal of your Content from the Site at any time and from time to time may delete or amend such Content. If you choose to remove your Content, the licence granted by you will automatically expire, however you acknowledge that the Company may retain archived copies of your Content.
Removal of Content
The Company reserves the right at its absolute and unfettered discretion and without obligation to give reasons for its actions or decisions, which it may or may not exercise, to use, copy, post, display, review, excerpt, edit or delete any Content, material or link that it deems to be inappropriate or in violation of these Terms and Conditions and to deny access to anyone who violates these Terms and Conditions.

The Company does not endorse and has no control over the Content. Content is not necessarily reviewed by the Company prior to posting and does not necessarily reflect the opinions or policies of the Company. The Company makes no warranties, express or implied, as to the Content or to the accuracy and reliability of the Content or any material or information that you transmit to other Community Members or Users.
The Company is not responsible for any incorrect or inaccurate Content posted on the Site or in connection with the Web Service, whether originating from Users or Community Members or otherwise or caused by any of the equipment, operations, programmes or programming associated with or utilised in providing the Web Service. Content created for or posted by Users and Community Members on the Site may contain links to other websites. The Company is not responsible for the Content, accuracy, reliability or opinions expressed on such websites, and such websites are NOT investigated, monitored or checked for accuracy reliability or otherwise by the Company. Inclusion of or facilitating such link does not imply any approval or endorsement of such site or site content by the Company. Media
The Company will distribute releases according to the media location(s) selected by you or us, and according to the preferred method of receipt as indicated in our media database. The Company uses its best efforts to provide you a media list that is accurate and complete. A member of the Company?s staff will distribute the release(s) to the media.
Press releases
The Company shall have no liability for the content of any press release or other information provided by a User or Community Member. The Company has no responsibility to verify any facts contained within any such content. Therefore, you represent and warrant that (i) you have the authority to submit news releases and other content to the Company for distribution; (ii) any person or party executing this agreement on your behalf is authorized to do so; (iii) the content you submit and its distribution will not violate any copyright, trademark or service mark rights, right of privacy or publicity or other right of any person, and such content is not obscene, libellous, slanderous or otherwise defamatory, false or misleading.
The Company reserves the right to reject any press release or other content you submit if we reasonably determine that the content is unsuitable for distribution and we shall have no liability for rejecting any press releases on those grounds. These reasons may include, but are not limited to: content which includes adult material, obscenities or profanity; content which promotes violence, illegal activities, discrimination based on race, sex, religion, age, nationality, sexual orientation or disability; press releases which appear to be an advertisement, call the reader to action, politically orientated, vary significantly from standard press release format or contain excessive grammatical or typographical errors. Moreover, we reserve the right to make non - material edits in headline, dateline, body and/or contact information for the purposes of making a press release or other content suitable for distribution.
Disputes with third parties
The Company shall not be liable for interactions by Users or Community Members with any organizations and/or individuals found on or through the Site or Web Service. By using our Web Service, YOU AGREE that the Company is not responsible for any damage or loss incurred as a result of any such dealings. The Company is under no obligation to become involved in disputes between advertisers, group event participants (whether for charitable purposes or otherwise), organizers and beneficiaries, or between Users, Community Members and any third party. In the event of a dispute, the User or Community Member releases the Company from all claims, damages and demands of whatever nature they may be - known or unknown, suspected or unsuspected, disclosed or undisclosed - arising out of or in any way related to such disputes and our Site or Web Service and shall not make the Company a party to any proceedings. The Company cannot be held liable for the actions of an group event organiser or donation fundraiser, organisers and fundraisers are nevertheless wholly responsible for fulfilling obligations both implied and stated in any group event or donation fundraiser they create. The Company reserves the right to cancel a listing at any time and for any reason. The Company reserves the right to remove an advertisement, group event, fundraiser or listing from our Site or Web Service for any reason.
Location and Jurisdiction
These pages are controlled and operated by the Company in the United Kingdom and are intended for use within Jersey. The Company makes no representation that materials on these pages are appropriate or available for use in other locations. Those who choose to access these pages from other locations do so on their own initiative and are responsible for compliance with local laws. These Terms and Conditions shall be construed and enforced in accordance with English laws. Any action to enforce these Terms and Conditions shall be brought in courts located in the United Kingdom.
Use of the Site and Web Service is also governed by our Privacy Policy, which is incorporated into this Agreement by this reference.

My Favourite Jersey, MYFJ, and MYFJ.com and other Company marks, graphics, logos, designs, buttons, icons, scripts, text and service names are registered trademarks, trademarks, registered business names and trade dress of the Company or may be copyrighted and may not be used, imitated, applied, or copied in any manner that is likely to cause confusion or amount to passing off and may not be used, imitated, applied or copied without the prior written consent of the Company.
Examples containing visuals, company logos, product and service name, or client samples may be trademarks, registered trademarks or service marks of other firms. Samples shown may be copyrighted by their publishers. Text and photographs are copyrighted by the Company and may not be duplicated for any purpose without consent. Inclusion of examples does not imply recommendations or endorsements by client companies.
It is the intent of the Company to ensure confidentiality when you visit our Site or use our Web Service. We may collect and store information obtained via the Site and Web Service from visitors who voluntarily provide information in contacting us and from other means. The Information We Collect

When you audition with MYFJ.com, you provide us with certain personal information, such as your name, your email address, your telephone number, your address, your gender, and any other personal or preference information that you provide to us.
When you enter the Site, we collect your browser type and IP address. This information is gathered for all Site Users. In addition, we store certain information from your browser using "cookies." When you audition for MYFJ.com, we set up your personal Profile and thereafter you may alter, change and amend the same. We collect this information so that we can provide our Web Service and offer personalised features. When you update information, we usually keep a backup copy of the prior version for a reasonable period of time to enable reversion to the prior version of that information.
You post Content (as defined in the MYFJ.com Terms and Conditions) on the Site at your own risk. We cannot control the actions of other Users and Community Members who visit the Site. Therefore, we cannot and do not guarantee that Content you post on the Site will not be viewed by persons and used by them in ways you find unacceptable or which you may consider infringe your rights. We are not responsible for circumvention of any security measures contained on the Site. You understand and acknowledge that, even after removal, copies of Content may remain viewable in cached and archived pages or if other Users have copied or stored your profile or Content.

Use of Information Obtained by MYFJ.com
When you audition for MYFJ.com, we create your profile. Your Profile information, are displayed to Site Users including other Community Members. We may occasionally use your name and email address to send you notifications regarding new services offered by the Company that we think you may find valuable.
The Company may send you Web Service-related announcements from time to time through the general operation of the Web Service.
The Company may use information in your Profile without identifying you as an individual to third parties. We do this for purposes such as aggregating how many people using the Web Service or entering the Site like a restaurant, place or attraction and personalising advertisements and promotions so that we can provide our Web Service to all Users and Community Members.
We may use information about you that we collect from other sources, including but not limited to newspapers and Internet sources such as blogs, and other Users of MYFJ.com.
Sharing Your Information with Third Parties
MYFJ.com is about sharing ideas and experiences. We do not provide contact information to third party marketers without your permission. We share your information with third parties only in limited circumstances where we believe such sharing is 1) reasonably necessary to offer the Web Service, 2) legally required or 3) permitted by you. We may provide information to service providers to help us bring you the Web Services we offer.
